1. Who these terms are between

These terms govern your use of this website, operated by ROInversion Off-Market — Carlos Olivares, Gasper Mavric, and Lina Rivera, licensed Florida real estate professionals with Berkshire Hathaway HomeServices EWM Realty. By using the site you accept them. If you do not, please do not use the site.

2. No offer, no advice

Nothing on this site constitutes an offer to sell, or a solicitation of an offer to buy, any property or security. Property profiles are marketing summaries. No statement here is legal, tax, accounting, engineering, environmental, or investment advice, and none of us is licensed to provide it. Engage your own advisors.

3. Information is not warranted

Property information originates with owners and third-party sources. We present it in good faith but we do not warrant that it is accurate or complete. Everything is subject to errors, omissions, changes in price or terms, prior sale, and withdrawal without notice.

Independently verify anything you intend to rely on — square footage, unit counts, income and expenses, lease terms, zoning, permitted use, structural and environmental condition, and title. Projected or pro forma figures are estimates, not promises, and actual results routinely differ.

4. Confidentiality

Property information on this site is confidential and provided solely so that you can evaluate a possible transaction. You may not republish it, forward it, or use it for any other purpose, and you may not approach an owner, tenant, or occupant directly regarding a property we introduced you to.

If you have signed a confidentiality and non-circumvention agreement with us, that agreement governs and controls over this section wherever the two differ.

5. Registration and verification

Access to confidential property information requires registration, execution of our confidentiality and non-circumvention agreement, and documentation of your identity, authority, and ability to complete a purchase. You agree that what you give us is accurate and that you are authorized to bind any entity you register on behalf of.

We apply published criteria uniformly, and we may decline or withdraw access at our discretion where those criteria are not met. Access credentials are personal to you and must not be shared.

6. How we are paid

Our compensation is paid by the seller under a written open (non-exclusive) listing agreement with that seller. Buyers pay us nothing — no access fee, registration fee, or success fee. Commissions are negotiable and are not set by law or by any real estate board.

We are a licensed real estate brokerage. We do not take properties under contract and assign those contracts on for a spread, and we are not wholesalers.

7. Brokerage relationship

Under Florida law a real estate licensee is presumed to be operating as a transaction broker unless a different relationship is established in writing. Our brokerage relationship disclosure is provided during registration and forms part of the agreement you sign.

8. Acceptable use

• Do not attempt to gain access to gated material you have not been granted.
• Do not scrape, harvest, or systematically extract content from the site.
• Do not misrepresent your identity, your authority, or your financial capacity.
• Do not use the site to interfere with an existing agency or brokerage relationship.
• Do not upload anything containing malicious code.

9. Intellectual property

The content, layout, and design of this site belong to us or our licensors. The Berkshire Hathaway HomeServices name and symbol are registered service marks of Columbia Insurance Company and are used under license. You may not reproduce site content without written permission.

10. Third-party links

Where we link elsewhere, we do not control and are not responsible for that content.

11. Limitation of liability

The site is provided "as is" without warranties of any kind, to the fullest extent the law permits. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits or lost opportunity, arising from your use of the site or reliance on information obtained through it. Nothing here limits liability that cannot be limited by law, including for fraud.

12. Fair housing and equal opportunity

We conduct business in accordance with federal, state, and local fair housing law and support equal opportunity in housing and lending.

13. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Disputes are subject to the exclusive jurisdiction of the state and federal courts sitting in Miami-Dade County, Florida.

These terms are written in English. Spanish and Portuguese versions are provided as a courtesy; the English version governs.

14. Changes

We may update these terms; the date at the top will change. Continued use of the site after an update means you accept the revised terms.
